By Sisonke Mlamla Jul 7, Cape Town – The City of Cape Town has reiterated that no evictions have been conducted at the site of a land invasion in Khayelitsha, as incorrectly stated in some media reports. The City also said that land invasions occurring in Empolweni, Khayelitsha, are jeopardising a R million water pipeline for the informal settlement.
The City explained that in terms of the Western Cape High Court order, the City of Cape Town is permitted to remove any new illegally erected structures on the land in question. In line with the court order, five illegal structures were removed on 1 July The day prior, 30 June , one illegal structure was removed. Only 49 structures have been temporarily allowed to remain by the High Court. This is monitored on an ongoing basis.
In April, the High Court permitted only 49 structures to temporarily remain on the land under strict conditions until the matter is heard in full. This invasion undermines services and housing in Khayelitsha as a whole, because the land is on the direct path of a R million water pipeline.

Informal trading is an everyday livelihood practice in South African cities. Although praised for its local economic development potential, in the post-Apartheid context, it often sits in tension with urban regeneration plans. Drawing on ethnographic fieldwork, this research explores the material and symbolic spaces and everyday practices of street trading in the KCBD—specifically, how traders negotiate their trading practices in a context of on-going development.
What we see in practice is informal traders existing in a complex space—caught somewhere between exclusionary urban regeneration projects, and waiting for the state. In this transitioning space, urban regeneration sits in tension with informal trading—a context in which these traders need to be given a voice, and where such research becomes valuable, in displaying a textured reality. In contrast with this official definition, in practice, informal trading is a loose and more innovative term, generally given to any small business that does not exist in a formal building structure nor adheres to formal economic structures, unlike formal registered traders. Over the last decade, however, it has increasingly been acknowledged and recognized in South African urban policy and development agendas as an important livelihood source for the urban poor and historically disadvantaged individuals and communities, and the notion of informality has been incorporated in public documents as an acknowledgement of the international developmental discourse on the value of informality.
However, the practice of informal trading in public space referred to as street trading in this paper often sits in tension with urban planning and regeneration projects—meaning that informal traders are forced to renegotiate their existence in these spaces of transition. The translation of this policy into practice is the source of much of the tension described above, and will be a major focus of this paper.
Several urban regeneration projects have and are taking place—reorganizing the space and shifting the role and responsibilities of the state, traders both formal and informal and various actors involved in these developments. This is where the tensions arise. On the other hand, and largely in response to the tensions that arise through the physical, we have traders waiting for development plans to materialize, but inventing and reinventing spaces for themselves in the meantime through individual negotiation, encroachments and innovation as well as collective action in an attempt to assert a space and a place for themselves and their businesses in the KCBD.
Although, most significant here is the observation that embedded in the spaces and relationships across both axes, is the true architecture of this complex and varied space: the everyday experiences of uncertainty, confusion and waiting.

This paper is based on research on vigilantism in Khayelitsha, a black township, on the outskirts of Cape Town, South Africa. Almost half of Khayelitsha’s households live below the food poverty line and there is a significant difference between income distribution within Khayelitsha vis-a-vis the Cape Town population. This paper argues that despite the fact that South Africa attained formal democracy in and has one of the most progressive constitutions in the world, the ‘nature and character of public participation’ is problematic, non-deliberative, and a reflection of blocked opportunities, poverty, and inequality Miller I argue that the discourse and rhetoric on ‘community’ is a shallow and dangerous form of incorporation that does not live up to its promises of full participation.
Not only is ‘community’ used as a tool to connect the state to the population but vigilantes also claim to act in the name of the ‘community. After a brief section on ‘Background and Methodology,’ I discuss the relationship between democracy and imprisonment, noting that South African democratization has witnessed a dramatic increase in long-term prison sentences. I argue that the government’s embracing of a restorative prison has enabled it to double back on its parsimonious, pre stance on imprisonment.
As a result, the prison and penal punitivism have become an important part of state building in newly democratic South Africa. In ‘Populist Politics and People’s Power,’ I discuss the historical relationship between violence and justice and argue that both ‘criminality’ and ‘community’ are highly contested terms that are subject to violent definitions and redefinitions.
